Presidentialism in the Chilean constituent processes. A special consideration about the design of the transitional norms

Abstract

This paper analyzes the Chilean presidential regime and its review of the three constituent processes that sought to replace the Political Constitution of the Republic of Chile. It focuses on the regime of transitional constitutional clauses to analyze the gradual implementation of the political regime. The structural deficiencies of the Chilean presidential regime are described through its constitutional evolution and the provisions of the current Constitution; the main proposals for change resulting from the second and third constituent processes are presented; and it reflects on how the transitory regime could have mediated the implementation of the proposed changes.
