The Anthropocene in Latin American Legal Scholarship: An Overview of the Contributions from Brazil and Mexico
Abstract
This research aims to verify, through a literature review of selected studies and doctrines from various Latin American countries, how the concept of the "Anthropocene" has been legally elaborated in the region, with a particular focus on the Brazilian and Mexican contexts. We found several authors defending new principles developed specifically in response to the Anthropocene climate crisis and the importance of recognizing the rights of nature and establishing international cooperation, beyond the idea of protecting the environment as a human right, but rather to recognize that the model must change, and nature must be protected as a subject of law.
