Wills formalities and testamentary freedom: pandemic emergence and digital transition
Abstract
Abstract: Wills formalities and testamentary freedom: pandemic emergence and digital transition - During the state of emergency due to the Covid-19 pandemic, the formal requirements for the validity of wills were under scrutiny in many legal systems, because of the difficulty to comply with these rules for people in isolation or quarantine. In this context, the use of digital technologies to make a will was questioned and some jurisdictions emended legislations about the will formalities. The Author analyses this phenomenon, from a comparative perspective, in order to evaluate how and to what extend the pandemic contributed to a digital transition of will formalities.
