Romanian Superior Council of Magistracy. Perspective of an ongoing transition

Abstract: Romania's achievement of the European Union membership has imposed deep legislative changes. Which brought the State’s magistrature closer to the independence, transparency and balancing standards. However, in 2017 the Romanian government started an ongoing reform of the magistrature legal system through emergency legislative acts. As a result, Romania's compliance to the obligations deriving from its European Union membership has been strongly jeopardized. This article analyses the evolution of the Romanian Superior Council of Magistracy as well as the conflict with the European institutions arising from the recent reforms.
