The legal connection between plan and contract in the law of the People’s Republic of China
Abstract
Abstract: The paper reconstructs the features and the incidence of the connection between socio-economic development plans and contract law in the current legal order of the People’s Republic of China. The passage from a directive to a more coordinative planning model is reflected both in the modification of the traditional hierarchies between plan and contract, typical of socialist law, and in the structuration of a comprehensive regime for public contracts, over which the influence of plans – as vehicles of national interests and policies – is significant, especially with regard to possible evolutions of contractual relations following changes in the underlying interests.
