The essay deals with the issue of the legal interpretation within the Constitutional State. It particularly focuses on the legal interpretation as applied to the guarantee of fundamental rights. After having explored the different theories of legal interpretation, the Author addresses the issue of the discretionary powers of judges; it further assesses the plausibility of a theory that advocates in favor of the introduction of the accountability of judges for wrongful interpretation.
