The different ways of producing the legal sources with a technical and scientific content in the era of the transnational law is a very interesting topic and is a test bench for the contemporary constitutionalism. This paper deals with four principal issues: i) the changes that affect the system of the sources of the law and the different methods to create sources with a technical and scientific content; ii) the interaction between law and other sciences and the resumption of the dialogue between jurists and “scientists”; iii) the breach of the traditional border between public and private law as well as between external and internal, namely the territorial limits of the legal orders as a consequence of the transnational validity
of the technical rules and of the regulation of technologies; iv) the problem of sovereignty in the digital era.
Keywords: Technical regulations; Science-based laws; Sources of law.
