Abstract

Abstract: Efficacy as a parameter for assessing the legality of the governance of the EU and its reforms ‒ The essay examines the economic and financial reform process of the Juncker’s Commission. The legitimacy of the macroeconomic instruments (or of the measures adopted by the Member States in compliance with them) adopted after 2008 crisis, has been the object of multiple pronouncements by the Constitutional Courts of the Member States, which have placed some limits on the new instruments, such as, for example, the pursuit of intergenerational equity; principle closely related to the stability of the financial system. Consequently, the analysis of the work of the Juncker Commission made by the European Court of Auditors is particularly interesting, as it underlines the ineffectiveness of the reforms implemented in obtaining a stabilization effect. Finally, the proposal of MFF 2021-2027, confirming also for the future, tools, objectives, and resources established by the previous Commission, allows us to fully understand how the juridical outcome of this choice is not
neutral.
