Democracy and fundamental rights: the case of same-sex marriage referenda in Ireland and United States

Abstract

The present paper intends first to outline the cultural positions underlying the very notion of marriage. Particularly, the aim is that of problematizing the use of referendum as the proper means to recognize same-sex marriage. In order to do so, it purports to analyze the recent constitutional reform entered into in Ireland; it further intends to compare the referendum experiences in recognizing the fundamental right to marriage for same-sex couples in Ireland and United States.
